Companies may receive notices from Health Insurance Marketplaces notifying them of any employees who may have enrolled in a Marketplace plan.  The following link provides some sample notices that employers could receive http://go.cms.gov/29QbeG5

Since employers can be subject to penalties under the Affordable Care Act, they can appeal the employee’s eligibility determination within 90 days from the date on the notice.  However, an appeal will not determine if the employer is liable to pay the potential penalty, only the IRS can make that decision.
